Right of withdrawal

1. Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason whatsoever, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.
2. In order to exercise the right of withdrawal referred to in Article 5.1 above, the Customer must send Rosa srl a communication to that effect, within the indicated deadline, to the following e-mail address [email protected] .
3. In the event of withdrawal, the Customer shall re-send the products at his own expense to Rosa srl within 14 (fourteen) days of withdrawal, to the following address la Sellerie Limited via Matteotti 15, 73024 Maglie (LE) Italy .

The goods must be returned undamaged, complete with all parts and in their original packaging (envelopes and wrappings), stored and, if necessary, used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without any signs of wear or soiling, in compliance with the conditions set out below:

• the right of withdrawal may apply to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, complements, etc.);
• for withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc.);
• shipping costs (and customs fees, if any) for the return of the goods shall be borne exclusively by the Customer.
• shipment, until the certificate of receipt in the warehouse indicated by Rosa srl, is under the full responsibility of the customer;
• in the event of damage to the goods during transport Rosa srl will inform the Customer, to enable him/her to file a timely complaint against the carrier chosen by him/her and obtain the relative refund; the product will then be made available to the Customer, at the same time cancelling the request for withdrawal;
• Rosa srl shall not be liable in any way for damage, theft, loss occurring during or in connection with the return shipment.

4. Rosa srl will refund the Customer the full amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of Legislative Decree 21/14, within 14 (fourteen) days from the withdrawal, by means of a reversal procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction. In any event, the Customer shall not incur any costs as a consequence of said refund except for the shipping costs (and customs fees, if any) for the return of the goods, which shall remain the sole responsibility of the Customer. 5. In any case, the Customer will forfeit the right of withdrawal in cases where Rosa srl ascertains that

• the returned product and/or its accessories, and/or its packaging are not intact;
• the product is missing its original outer packaging and/or inner packaging;
• the product is missing integral elements of the product and/or accessories (e.g. fasteners, laces, buckles, etc.).

In the event of forfeiture of the right of withdrawal, Rosa srl will return the purchased product to the sender, charging the sender for the shipping costs and, if already refunded, the price of the product.

Delivery of products and related costs

1. The purchased products will be shipped to the address indicated by the Customer in the Order within 2/4 hours from the acceptance of the Order by Rosa srl , at the cost specifically indicated on the Site before sending the Order. Rosa srl reserves the right to accept or refuse deliveries requested outside of Italy or Europe. In any case, for deliveries to be made outside of Italy, shipping costs and delivery times may vary.
2. With regard to deliveries to countries outside the European Union, any customs import charges will be borne by the recipient. We therefore invite the Customer to contact the customs authorities of his country in advance to check the costs and any import limits.
3. The delivery times indicated by Rosa srl are to be considered purely indicative and a delay in respect of the same, or any delivery made in successive split shipments, will not entitle the Customer to refuse delivery and to claim compensation or indemnity.
4. Upon delivery of the products, the Customer shall check:

• that the number of packages delivered corresponds to the number indicated in the transport document.
• that the packaging is intact, undamaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal strapping).

Any damage to the packaging and/or the product or the mismatch in the number of packages or indications shall be immediately detected, with a specific indication on the delivery note of the product to be returned to the courier.

Any problems with the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in the manner provided for herein.

GENERAL TERMS AND CONDITIONS OF SALE

1. Acceptance of general terms and conditions and conclusion of contract

1.1 The contract stipulated between Rosa srl and the Customer (i.e. the individual, natural person, who makes the purchase on the Site, not related to his or her own commercial, entrepreneurial or professional activity) is concluded with the acceptance, even partial, of the order by Rosa srl. In case of non-acceptance of the order, Rosa srl will in any case promptly inform the Customer.

1.2 By placing an order in the various ways provided, according to the order form on the Site (hereinafter the Order), the Customer declares that he/she has read all the information provided to him/her during the purchase procedure and fully accepts these general conditions (hereinafter the Conditions).

1.3 These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. Purchase modalities

2.1 The products offered for sale by Rosa srl are only those on the La Sellerie Limited website at the time the Order is placed, as described in the relevant information sheets.

2.2 It is in any case understood that the images accompanying the product description sheet are for information purposes only and may not be perfectly representative of the product's characteristics but may differ e.g. in colour and size (also depending on the browser and monitor used to access the Site and display the images).

2.3 In order to place an Order the Customer will have to fill in the relevant form on the Site in all its parts and send it after having carefully examined the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also request Rosa srl, if he/she so wishes, to issue a fiscal invoice for the purchase, pursuant to article 22 D.p.R. n. 633/1972.

3. Prices and Methods of Payment

3.1 The prices indicated on the site are inclusive of taxes and VAT. Any shipping costs or payment charges are in any case communicated to the Customer in advance via the site or these Conditions.

3.2 The following payment methods are provided for:

(i) PayPal
For payment, the customer may use the Paypal circuit in accordance with its specific terms.

(ii) Credit card
In the case of purchasing goods with Credit Card payment method, the transaction may take place through the Paypal secure server or any other secure server chosen by Rosa srl.

Under no circumstances and at no stage of the payment process will Rosa srl be able to know the information relating to the Customer's credit card, transmitted via secure connection directly to the site of the bank handling the transaction. No Rosa srl computer archives will retain such data and therefore under no circumstances can Rosa srl be held responsible for any fraudulent or undue use of credit cards by third parties at the time of payment.

8. Privacy

Any further processing will be carried out only with the express consent of the Customer.
